Terms of Service

1. Acceptance of Terms
By creating an account or using JWithKP HRMS ("the Service") you agree to these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users including administrators and employees accessing the platform.
2. Description of Service
JWithKP HRMS is a cloud-based human resources management platform providing payroll processing, statutory compliance (PF, ESI, GOSI, WPS), attendance tracking, asset management, and related HR workflows. Features vary by subscription plan.
3. Account Responsibilities
You are responsible for maintaining the confidentiality of your login credentials, all activity under your account, and ensuring that employee data entered into the platform is accurate. You must notify us immediately of any unauthorised access at support@jwithkp.com.
4. Acceptable Use
You may not use the Service to violate any applicable law; process data of individuals without lawful basis; attempt to gain unauthorised access to other accounts or systems; or reverse-engineer any part of the Service.
5. Subscription and Billing
The Starter plan is free up to 10 employees. Paid plans are billed monthly or annually in advance. Pricing is shown on our Pricing page. We reserve the right to change pricing with 30 days' notice. Refunds are not provided for partial billing periods.
6. Data Ownership
You retain ownership of all employee and company data you input into the Service. By using the Service you grant us a limited licence to process that data solely to provide the Service to you. We do not claim ownership of your data.
7. Availability and SLA
We target 99.97% monthly uptime. Scheduled maintenance will be communicated in advance. We are not liable for downtime caused by factors outside our reasonable control (force majeure, third-party infrastructure outages, etc.).
8. Termination
Either party may terminate the agreement with 30 days' written notice. We may suspend or terminate accounts that violate these terms immediately. Upon termination you may export your data for 30 days after which it will be deleted.
9. Limitation of Liability
To the maximum extent permitted by law, our aggregate liability for any claims arising from use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.
10. Governing Law
These terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in India.
